Bylaws of the Board
Powers of the Board
1. The
Board has the power to employ personnel and contract for goods and services
necessary for the operation of the school district.
2. It
has the power to be sued and to sue and to hold and convey property for the use
and benefit of the district.
3. It
has the power of calling or causing to call the elections for certain purposes
among the voters of the district.
4. It
has the power of eminent domain.
5. It
has the power of requiring rules and regulations for the operation of the
school district.
6. It
has the power of being fiscally independent or of causing taxes to be levied
for the support of the school district.
7. It
has the power of establishing its own procedures.
8. It
has the responsibility of determining the educational program and services of
the school district consistent with state law.
9. It
has the power of appraising and reviewing its actions and policies.
10. It retains all of
its powers and authority to direct and control the district to the full extent
of the law. Included in those
duties and powers is the right to: direct the work of its employees; determine
the method, means and services to be provided; determine the staffing patterns;
determine the number and kinds of personnel required; maintain the efficiency
of the district operation; develop a budget; determine the methods of raising
revenue; and contract out work. In
addition, the Board retains the right to evaluate, hire, promote, terminate and
discipline employees, and is responsible for the work of the employees of the
district.
11. It retains the
right under law to amend, modify or rescind policies and practices; in cases of
emergency change, modify or rescind any existing policy or provision or create
a new policy; determine whether or not an emergency exists; and to take action
on any matter in the event of an emergency.

12. It has broad but
clearly limited powers. The
exercise of its authority is restricted to the functions required or permitted
by law, and then only when it acts in a legally constituted meeting.
